CONSTITUTION AND BY-LAWS OF THE DUPAGE COUNTY SHERIFF’S POLICE, M.A.P. CHAPTER #126

 ARTICLE 1:   (Organization, Name, Objective)

 Section 1:  Name

                        - This Association shall be known as the DuPage County Sheriff’s Police Department (D.C.S.P.D.) Metropolitan Alliance of Police (M.A.P.) Chapter #126, which is directly affiliated with the Metropolitan Alliance of Police.  The principle place of business of this chapter shall be in DuPage County, State of Illinois.

                        - The D.C.S.P.D. M.A.P. Chapter #126 will consist of sworn deputies from the Law Enforcement Bureau and sworn deputies from the Administrative Bureau and any and all other sworn personnel acknowledged by Illinois Labor Relations Board Certification. 

                        - The purpose and intent of the D.C.S.P.D. M.A.P. Chapter #126 shall be to promote peaceful labor relations for the mutual interest of the County of DuPage in its capacity as an employer and the members of the D.C.S.P.D. M.A.P. Chapter #126.

                        - The D.C.S.P.D. M.A.P. Chapter #126 represents and is entitled to act for and negotiate agreements and contracts concerning compensation, grievances, personnel practices and matters affecting the general working conditions of members of the D.C.S.P.D. M.A.P. Chapter #126.

                        - The D.C.S.P.D. M.A.P. Chapter #126 encourages friendly and cooperative relations between all employees, the employer and the community, in an effort to foster harmonious labor relations.

 Section 2:   Duration                    

                        - The Chapter shall have a perpetual existence.

 Section 3:   Powers of Chapter Vested in Members

                        - The powers of the chapter shall be vested in its membership but may be exercised by an Executive Board, consisting of the President, Vice-Presidents, Secretary, Treasurer and Board of Governors and Directors.

Section 4:   Revisions

                        - These by-laws may be revised on an as-needed basis.  Revisions and amendments must be voted upon by a simple majority of Local Chapter #126 members present at a regularly scheduled M.A.P. Chapter #126 meeting.

ARTICLE 2:   (Definitions of Officers, Qualifications, Explanation of Powers and Duties, Membership)

Section 1:   Powers and Duties of Officer

                        - The Officers of the Chapter, who will be considered the Executive Board, shall be the President, Vice-President Law Enforcement Bureau (LEB), Vice-President Administrative Bureau (AB), Secretary and Treasurer, all of whom shall be elected by the membership in a secret ballot election with votes being sent directly to the M.A.P. office where votes will be tallied.  An interim Executive Board will be established and positions will be appointed from within as a means of necessity and to facilitate the purpose of D.C.S.P.D M.A.P. Chapter #126 as described in ARTICLE 1, SECTION 1.  This interim Executive Board will be in place until the first general meeting of the Local Chapter following the first effective date of the first contract.

                         - Said Executive Board shall be the governing body and shall have the legal custody, control and management of all funds, property and effects of Chapter #126.  The President, Vice-President (LEB), Vice-President (AB), Secretary, Treasurer and Board of Governors, respectively, shall hold office for a term of three (3) years, or until their successors have been duly elected and qualified.

Section 2:   Qualifications of Officers and Candidates

                        - No member may be a candidate for office who is not in good standing.  No Officer may continue in office or perform the duties or exercise the authority of any office if he/she is found not to be in good standing.  A good standing member is that member who voluntarily pays member dues while demonstrating a positive image, conduct and morale in the promotion of the welfare of fellow members and M.A.P.

Section 3:   Officers to Serve Without Compensation

                        - Each of the officers and members of the various committees shall serve without receiving compensation.

Section 4:  President: Powers and Duties

                        - The President shall call and preside over all meetings, appoint all committees, manage and direct all affairs of this Chapter and shall perform such duties and functions of the office of President.  Duties shall include, but not limited to; contract bargaining, grievance assistance, disciplinary representation, assignment of grievance numbers and all other duties and responsibilities brought before them by their membership and the M.A.P. Board.  The President is the Chief Officer of the Chapter and will act as the primary liaison to the M.A.P. Board.

Section 5:  Vice President (LEB) and Vice President (AB): Powers and Duties

                        - In the event of the President’s absence, inability to perform duties and/or refusal to act, the Vice-President (LEB) and Vice-President (AB), combined, will conduct all duties of the President as described in ARTICLE 2, SECTION 4.

Section 6:  Secretary: Powers and Duties

                        - The Secretary shall keep a record of all of the proceedings of general and special meetings and every other record made or required by the provision of the Constitution and By-Laws of this Chapter, and shall receive and file all correspondence and other papers.

                        - He/she shall serve, issue and publish all notices that are required to be given to all appropriate individuals.  He/she shall prepare (with M.A.P.) all ballots under the direction of the President or Vice-President (LEB) and Vice-President (AB), combined.  He/she shall receive all applications for membership, prepare all certificates of membership and any and all other certificates of records required and shall complete record thereof.

                        - In the event of the Secretary’s absence, inability or refusal/neglect to do or perform his/her duties of this office, any individual directed to do so by the President shall perform such duties.

Section 7:  Treasurer: Powers and Duties

                        - The Treasurer shall receive all funds of this Chapter and shall dispose or invest such funds under the direction of the President or Vice-President (LEB) and Vice-President (AB), combined, and shall keep an accounting of all receipts and disbursements of the Chapter and assist in other various duties as deemed by the Board.

Section 8:  Sergeant At Arms: Powers and Duties

                        - The above shall attend each regularly scheduled meeting along with the members of the Executive Board.  Sergeant At Arms will maintain order at local Chapter meetings and will assist in any and all other duties as deemed by the Executive Board.

Section 9:  Chief Union Representative and Union Steward: Powers and Duties

                        - The above shall attend each regularly scheduled meeting along with the Executive Board members and act as a liaison between the Chapter and its members and the M.A.P. Board.

                        - The Chief Union Representative shall oversee all Union Stewards in assigning and following up on all grievances.  Each Union Steward shall be responsible for assisting members in the filing of grievances and arguing on their behalf as each step follows in its hierarchy.

                        - The Chief Union Representative will promote M.A.P. Union to members and will also disseminate information to the members and to the M.A.P. Board.  The M.A.P. Board appoints the Chief Union Representative.  The Union Stewards are elected by general membership for a two-year term.

Section 10:   Succession Rights

                        - If at any time the President refuses or becomes unable or disqualified to act, the Vice-President (LEB) and Vice-President (AB), combined, shall assume all duties, powers and functions of the President for the duration of the existing term.

Section 11:  Special Meetings: By Call of Initiative

                        - The President, at his/her discretion, may call special meetings.  In the event of the President’s absence or inability to act, the Vice-President (LEB) and Vice-President (AB), the Secretary, Treasurer or the Chief Union Representative may call meetings which are requested in writing by a majority of the members who are in good standing.

                        - The President, or in his/her absence or inability to act, or any other officer of the Chapter as described in ARTICLE 2, SECTION 10, must first call such meeting within fifteen (15) days after the filing of such petition.  Petitions requesting such meetings shall state in clear and concise language the reason for the meeting and matters which will be addressed at the meeting.  Included in this petition will be the description of the matters of question, propositions, affairs and any and all other described business.  A majority of members, in good standing, shall be deemed sufficient for the transaction of this described business for which such meeting is called.  A majority vote of all members present shall decide the matters in question, propositions and/or affairs for which the meeting was originally called.

Section 12:   Removal and Recall of Officers

                        - Any Officer of this Chapter may be recalled or removed from office for willful neglect of performance of his/her duties in relation to this Chapter or the M.A.P. Union.  These acts are only limited when they directly affect the welfare of this Chapter.  Provided, however, whenever such Officer is to be removed, he/she shall be served with a copy of the notice of his/her suspension, pending hearing and trial on the charges forming the basis of his/her contemplated removal.  Such charges must be set forth in clear and concise language, signed by the President and two-thirds (2/3) of the body of membership.

                        - Provided further, if the officer against whom charges are brought should be the President, then the charges must be signed by the Vice-President (LEB) and Vice-President (AB) along with the Secretary, Treasurer and Chief Union Representative.

Section 13:  Amendments

                        - This Chapter may, from time to time, make additional By-Laws or revisions or amend or repeal the By-Laws or any part thereof, by an affirmative vote of the Executive Board, which may be by means of either a secret ballot or hand vote.  Any member of the Chapter may propose amendments, additions or repeals.

Section 14:   Membership Committee

                        - The membership committee shall consist of the Executive Board and the Chief Union Representative.  The committee shall receive and assess all applications for membership, appointments or reinstatements which shall be verbal or written.  The committee shall conduct voting for new applicants, reinstatements or dismissals.

                        - The committee shall determine the validity of member complaints relating to the active or inactive status of any Chapter member.  Questions concerning status will incorporate the opinions and votes of the committee, as well as members of the Chapter who are in good standing.

                        - Any sworn police officer, after completion of the basic police training as prescribed by the State of Illinois Training Board and who is assigned to the Law Enforcement Bureau of the DuPage County Sheriff’s Office, and, any Deputy administratively assigned to the Administrative Bureau acting in the capacity of sworn Court Security, as defined by the Illinois Labor Relations Board Certification, will be assumed to be a temporary member of this Chapter.  An application for these above described individuals must be done prior to a regularly scheduled meeting.  The applications will be announced at the next scheduled meeting and will be then voted upon by the Executive Board.  Two-thirds (2/3) of said Officers present must cast an affirmative vote in favor of approval before permanent membership is granted.

                        - Any member may terminate his/her membership upon submission of his/her resignation.  Dismissal, by majority rule, will cause said member to receive a ten-day (10) notice of the dismissal decision which will be prior to the next regularly scheduled meeting.  The member who resigns, or who is dismissed, will then be considered fair share for dues purposes.  The member will not receive M.A.P. Legal defense benefits and will be considered in bad standing.

                        - A two-thirds (2/3) vote of the Executive Board and the presence of the Chief Union Representative is required for the determination of an Officer’s status.  The involved Officer will not participate in this voting.

                        - Prior to the vote being taken, the Chapter may debate the issues at hand and may excuse the Officer from such discussion.  The Officer involved will be notified of the outcome of the vote as soon as possible, after the vote has been taken.

                        - Any Officer deemed not in good standing forfeits his/her rights to all dues and/or penalties paid previously and all voting and attendance privileges, as well as other functions of the Chapter.

                        - Members in good standing who leave the employment and are no longer a member of the D.C.S.P.D. M.A.P. Chapter #126 are not entitled to dues incurred during their tenure.  All monies sustained become assets of this Chapter which may be used at the Chapter’s discretion.

                        - Any member of this Chapter who misses regular quarterly meetings due to unexcused absences is subject to disciplinary action.  Any member in good standing who violates the trust, reputation, growth or purpose of this Chapter is subject to dismissal.

                        - Any member not in good standing, who violates the trust, reputation, growth, or purpose of this Chapter, will be executed from future consideration of becoming a member in good standing

                        - Members not in good standing must submit in writing their request for reinstatement, which will be presented and discussed at the next regular monthly meeting of the Executive Board.  A secret ballot vote will be held by those Officers present and a two-thirds (2/3) favorable vote of the Executive Board will reinstate the member to status of good standing.

 

Article 3    (Miscellaneous Dues, Expenditures, Elections)

Section 1:   Dues

                        - The local dues of the D.C.S.P.D. M.A.P. Chapter #126 shall be set by the Executive Board and may be changed without notice as long as said dues are not equal to half (1/2) the dues a member pays to the M.A.P. Union.

Section 2:   Expenditures

                        - The Executive Board of Chapter #126 has the sole responsibility of authorizing disbursement of funds for any benevolent purpose that benefits its membership, as long as said disbursement does not exceed $500.  Disbursements of $500.01 or more must be authorized by a simple majority of members present at a regularly scheduled Chapter meeting.

Section 3:    Meeting with M.A.P. Board

                        - The M.A.P. Board shall monitor all future elections of Chapter #126 Officers and Union Stewards.  Protocol will be that nominations will be sought via U.S. mail.  Ballots will be subsequently prepared by the M.A.P. staff (containing the corporate seal) and mailed to each D.C.S.P.D. M.A.P. Chapter #126 member via U.S. mail.  No proxy votes allowed but this rule may be amended in the future.

                        - After fourteen (14) days of the postmarked date of the ballots which have been received by the M.A.P. office via U.S. mail, the ballots shall be opened only in the company of two (2) Executive Board members, the Chief Union Representative and the M.A.P. President or his/her designee.  Any other interested party who is presently a good standing member of D.C.S.P.D. M.A.P. Chapter #126 may be present when the ballots are opened and tallied. 

                        - The results of each monitored election will be final and such ballots will be stored at the M.A.P. office for a period of six (6) months.

Section 4:    M.A.P. Monitored Elections

                        - The M.A.P. Board shall monitor all future elections of Local Chapter #126 of Officers and Union Stewards.  Protocol will be that nominations will be sought via U.S. mail.  Ballots will be subsequently prepared by M.A.P. staff (containing the corporate seal) and mailed to each D.C.S.P.D.
